I am seeing more and more folks having their own auto insurer denying payment of medical bills under their PIP coverage. The denial might be based on the insurance company picking a doctor who examines the insured person and saying the person is not hurt or the person does not need further treatment. The insurance company doctor will say this even when there is clear, objective evidence from the injured person’s own treating doctor to the contrary. The insurance company may also have a doctor review the injured person’s medical records and say the person does not need further treatment. Unfortunately, these treatment cut offs may result in the injured person not having access to more treatment because their doctors may not want to risk the uncertainty of not getting paid. There is a remedy for the injured person in that they can bring a lawsuit against their own insurance company to pay for the medical treatment.
